Noncompliance Area: A staff forcefully pulled the child down the hallway by their arm and yanked them down to a sitting position.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Noncompliance Area: There was ratio non- compliance on 9/20/19 upon review of facility. There were eleven preschoolers being cared for by one staff. On a previous visit that took place on 8/26/19 there was ratio non compliance throughout the facility during the inspection. There were nine young toddlers and two older toddlers with one staff upon OCDEL arrival then. Multiple alternate staff went into the room to bring the room into compliance. There were eleven preschoolers and three young school age children present with one staff upon arrival on the second floor of the facility. Lastly, there were ten older toddler and one staff in the rear room at the completion of naptime. The staff attempted to lengthen naptime yet multiple children got up off their cots and walked around.

Correction Required: The legal entity must submit documentation in a format approved by DHS proving that the facility is maintaining the required staff:child ratios at all times.

Noncompliance Area: One staff supervised nine children in the yard, of which eight of those children were older toddlers and the other child in their arms was a younger toddler.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level).

Noncompliance Area: Peeling paint was present in the stairwell leading up steps between the second and third floors.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: Child required emergency medical care while in care at facility and Provider did not call the authorities or accompany child to hospital.

Correction Required: A staff person shall accompany a child to a source of emergency care and shall remain with the child until the parent assumes responsibility for the child's care.

Noncompliance Area: Child required emergency room treatment while in care at facility; provider did not contact regional office within 24 hours as required.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

Noncompliance Area: The infants whom were napping did not have at least 2 feet of space as required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use at the time of the monitoring inspection.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Noncompliance Area: A infant endured swollen eyes and a medical condition while in the care of staff whom did not monitor the situation ongoing throughout the day.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times.

Noncompliance Area: During the unannounced monitoring, OCDEL rep observed a preschool lick sunflower butter from a metal butter knife and place the knife back into the container. The container was then passed to a peer. The staff was alerted and a staff person swirled the knife around in the mixture and attempted to give the sunflower butter to other children so they could place some onto their apples for afternoon snack.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training.

Noncompliance Area: Staff did not notify the parent as soon as possible while the child's health concerns progressed.

Correction Required: If a child becomes ill at the facility, the operator shall notify the child's parent as soon as possible.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. IF USING TIERED LIS: The required staff:child ratios must be maintained at all times. The legal entity must submit documentation in a format approved by DHS proving that the facility is maintaining the required staff:child ratios at all times. The legal entity will confirm continuing compliance by sending copies of the documentation to the -------- Region Office on a weekly basis for a period of two months after DHS approves the documentation format.

Noncompliance Area: During renewal inspection on 01/18/19, surface underneath mat on changing table in the Infant room was covered in debris and needed to be cleaned.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: During renewal inspection on 01/18/19, mats used as rest equipment in the 2nd floor classroom were ripped, and not labeled for individual use .

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: During renewal inspection on 01/18/19, refrigerator in the Toddlers room had spillage in the bottom and needed to be cleaned.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45 F or below. An operating thermometer shall be placed in the refrigerator.

Noncompliance Area: During renewal inspection on 01/18/19, written plan of daily activities was not present and posted on the 3rd floor.

Correction Required: A written plan of daily activities and routines, including a time for free play shall be established for each group. The plan shall be flexible to accommodate the needs of individual children and the dynamics of the group. The written plan of daily activities shall be posted in the group space.
