Noncompliance Area: The physical site inspection of this facility renewal occurred on 8/13/20. A review of the staff files was conducted and violations regarding staff having a health assessments conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. Staff #2 had a health assessment dated for 2/7/18, staff #3 last had a health assessment dated 7/10/18, staff #7 last had a health assessment dated 10/2/17, staff #8 last had a health assessment dated 7/3/18.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

A review of the staff files was conducted and violations regarding staff having a positive Tuberculosis test. Staff #3 had a TB test dated 7/13/18 and no further documentation on file that includes the results of a chest x-ray and evaluation for chemoprophylaxis.

Correction Required: A record of a person with a positive tuberculin skin test shall include the results of a chest x-ray and evaluation for chemoprophylaxis.

Staff #9 had a health assessment that did not include an examination for communicable diseases and the results of that examination.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination.

Noncompliance Area: The physical site inspection of this facility renewal occurred on 8/13/20. A review of the staff files was conducted and violations were observed. None of the ten staff files contained the National Sex Offender Registry (NSOR) as is required. The Child Protective Services Law(CPSL) was revised to include the requirement for the NSOR clearance effective 9/30/2019. The CPSL also states that anyone hired before 9/30/19 had until 7/1/20 to obtain this clearance. The following staff have been employed at the center before 9/30/19 and at the time of inspection the files did not contain the completed NSOR clearance. Staff #4 was hired on 2/10/20 and did not have the NSOR which was required at the time of employment for all employees hired after 9/30/20. Staff #1, Staff # 2, Staff # 3, Staff # 5, Staff #6, Staff #7, Staff # 9,and Staff # 10 were working with children during this inspection.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Persons # 1,#2, #3, #4, #5, #6, #7, #8, #9, #10, may not work in a child care position at the facility.

Noncompliance Area: The physical site inspection of this facility renewal occurred on 8/13/20. While conducting this visit the inspector observed the ceiling tiles in the infant room and the "yellow" room to be stained with water marks.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: On 9.5.19 a renewal inspection was conducted. In the green apple A room (infants) the water temperature was tested with the state issued thermometer. The temperature of the water is 123 F. On 11.7.19 a verification visit was conducted. The water in the green apple A room (infants) was so hot, it burn the inspectors hand and made the inspections hand red.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: The green apple a and b room, orange room, purple room, yellow room, brown room, pink room, and the school age room do not have play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use. Inspector observed a maximum of 10 different types of toys in a room. In the green apple room b room, there were 7 older toddlers and 4 preschools in the room. There were not enough toys for all the children to have a toy. In the pink room, inspector observed only books. In the school age room (next to the kitchen) and school age 1 room (the room by the entrance) inspector did not observe any play equipment and materials appropriate to the developmental needs, individual interests and ages of the children

Correction Required: Play equipment and materials appropriate to the developmental needs, individual interests and ages of the children shall be provided in sufficient amount and variety to preclude long waits for use. Play equipment and materials shall include the items specified at 3270.101(c)(1) - (6).

Noncompliance Area: Inspector observed 6 cribs that did not have the ASTM certified stamp. Provider was unable to provide proof that crib was certified and safe for use. Inspector observed 2 cots that had frayed/torn corners in the red/brown room and 3 torn mats in the green room and in the sky blue room. In the purple room, inspector observed 4 torn mats.

Correction Required: Children's toys and equipment, including furniture and rest equipment, described as hazardous by the United States Consumer Product Safety Commission may not be used by children at the facility and may not be on the premises at the facility. At the time of inspection, the operator shall submit to the Department written affirmation on a form provided by the Department stating that the facility is in compliance with this requirement.Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Noncompliance Area: In the green apple a room, inspector observed 2 seats in the high chair table that are missing straps.

Correction Required: High chairs shall have a wide base and a T-shaped safety strap.

Noncompliance Area: The written plan of daily activities is not posted in the school age room 1, school age room (2nd floor) and the pink room .

Noncompliance Area: Providers handbook and other paperwork given when enrolling their children does not include the facility's general daily schedule and fees therefore at the time of enrollment, a parent does not receive in writing the facility's general daily schedule and fees.

Manufacturers' instructions for use of safety restraints shall be kept in the vehicle at all times.

Noncompliance Area: Child 2's parent did not review and update the financial agreement at least once in a 6-month period. Child 2 has a fee agreement on file dated 11.16.18.
