Noncompliance Area: Observed a black and green Chicco brand high chairs with missing straps. During lunch, observed child #4, an infant, sitting in the green and tan Graco brand high chair not strapped. Therefore, all 3 high chairs were not equipped as intended by the manufactures' guidelines. Also, upon arrival, observed #3 sitting in a brown and pink not strapped in while staff #2 was feeding said child.

Correction Required: High chairs shall have a wide base and a T-shaped safety strap.

Noncompliance Area: The file of child #1 lacked an emergency contact form with the name, address and telephone number of the child's physician or source of medical care.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Noncompliance Area: During the time of the inspection, there were not copies of emergency contact forms present in each child care space for the children whom were receiving care in said spaces.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: Upon arrival, cert rep observed staff #2 spoon feeding child #1, an infant sitting in a high chair not wearing a mask or face covering. Observed staff #3 not wearing a mask while providing direct care to children. Upon arrival, observed child #4, an infant sitting in a Bumbo seat which was sitting on a desktop.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The file of staff #1 who resided out of PA in last 5 years did not have clearances from West Virginia on file during the time of the inspection.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: Upon arrival, cert rep observed 8 children in care. Staff #2 identified 2 children in care, both infants. As staff #2 was naming the children, Staff #3 went into the infant room which had the door closed to get child #1 who was sleeping in a pack and play unsupervised. At that time, staff #2 named child #1. Staff #3 identified 5 children in care: 4 toddlers and 1 pre-school age child. At this point, cert rep observed 9 children in care. One child, an infant, child #2, was not identified by either staff person. In addition, child #2 was grouped with the toddlers, pre-school child and staff #3. Therefore, staff #3 was out of ratio during most of the inspection.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level). Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: Observed fencing for the outdoor play space that was not secure. Therefore, it would not provide a barrier to restrict children from those unsafe areas or conditions, such as the street and major roadway.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.

Noncompliance Area: Observed a section of industrial rubber baseboard trim missing on the walls at the corner of the infant room and multi-purpose room; thereby exposing flaking sheet rock material.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: The file of staff #2 lacked two written nonfamily references, child care experience, and education.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility. A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person

Noncompliance Area: Based on conversation with the owner staff #1 resided out of state in the last 5 years. The file of staff #1 lacked documentation of clearances from the state in which he resided.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Noncompliance Area: At the time of the inspection, there was not designated play space for large muscle activity.

Correction Required: A facility shall provide outdoor or indoor play space to be used for large muscle activity which includes running, jumping, climbing and riding.
