Noncompliance Area: During the Renewal Inspection on 8/23/2019, the agreements on file for Child #1 and Child #4 did not specify the fee amount to be charged per day or per week.

Correction Required: An agreement shall specify the amount of the fee to be charged per day or per week.

Noncompliance Area: During the Renewal Inspection on 8/23/2019, Child #2 and Child #3 did not have updated child service reports on file. Both children have attended for longer than 6 months.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: During the Renewal Inspection on 8/23/2019, the most recent health report on file for Child #1, an infant at the time was dated 12/10/2018.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler

Noncompliance Area: During the Renewal Inspection on 8/23/2019, Staff #3 did not have proof of annual fire safety training on file within the previous 12 months. Staff #3 did obtain annual fire safety.

Correction Required: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: During the Renewal Inspection on 8/23/2019, Staff #1 and Staff #2 were observed working with a mixed age group of 6 young toddlers and 6 older toddlers. One staff was assigned to the 6 older toddlers and the one staff to the 6 young toddlers The required ratio for the young toddler group is 1 staff to 5 children.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level). The required staff:child ratios must be maintained at all times.

Noncompliance Area: During the Renewal Inspection on 8/23/2019, a cracked outlet cover case with sharp edges exposed was observed in the toddler classroom. The radiator guard in the young school classroom was also loose leaving sharp edges exposed.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Radiator guard in classroom was repaired.

Noncompliance Area: During the Renewal Inspection on 8/23/2019, peeling paint was seen near the sink in the upstairs bathroom. Peeling paint was also seen on the window sills in the young school age classroom and classroom 5 upstairs.

Noncompliance Area: On 8/8/2019 at 7:25 AM, Staff #2 was working alone in a classroom with a mixed age group of 8 preschool and school age children. Staff #2 left the room to answer the door. This left the classroom unsupervised for 1 to 2 minutes.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: On 8/8/2019 at 7:20 AM, Staff #1 was observed working alone in a classroom with a mixed age group of 5 children, that included infants and young toddlers. Two of the children were infants and three were young toddlers. The required ratio for this combined age group is 1 staff to 4 children.

Correction Required: The legal entity must demonstrate continuing compliance with the required staff to child ratios through unannounced monitoring visits by DHS on a monthly basis to be conducted for a period of three months after DHS receives acceptable plans of correction from the legal entity. When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level). The required staff:child ratios must be maintained at all times.

Noncompliance Area: On the morning 12/21/2018 at Freemansburg Elementary School, 7 school age children were observed exiting a mini-van that the facility uses to transport children. The names and ages of the 7 children were requested from the facility in order to know if any of the children required/require child booster seats. The requests were made as follows: Phone conversation with Staff #1 on 12/28/2018, emails to the facility on 1/4/2019 and 1/9/2019, and phone conversation with Staff #2 on 1/22/2019. As of 1/28/2019, this information has not been provided by the facility.

Correction Required: A staff person shall provide to agents of the Department immediate access to the facility, the children and the files and records.

Noncompliance Area: On the morning of 12/21/2018, Staff #1 was observed dropping off a group of school age children at Freemansburg Elementary School. Seven children were observed exiting a mini-van that is designed for 7 passengers (Including the driver). Staff #1 stated that two of the smaller children shared a seatbelt in the backseat

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Safety restraints installed in the vehicle at the time of manufacturing shall be used by all occupants.

Noncompliance Area: On 9/27/2018 at 2:20PM, Staff #1 was observed to be alone in a classroom with a mixed age group of 9 infants/young toddlers. Staff #1 was asked how many of the children were infants and how many were young toddlers. Staff #1 stated that 4 of the children were infants and 5 were young toddlers. Staff #1 stated that she was alone because it was nap time.

The staff:child ratio while toddlers and preschoolers are napping is one staff person to 10 young toddlers, one staff person to 12 older toddlers, one staff person to 20 preschool children

Noncompliance Area: During the renewal inspection on 8/17/2018, Staff #1 was working alone in a classroom with 12 children. The children were identified as young school age children. However, three of the children had not yet started kindergarten on 8/17/2018. One of these three children will be age 4 until 9/17/2018.

Noncompliance Area: During the renewal inspection on 8/17/2018, the first-aid kit in toddler classroom was missing bandaids, gloves, and tape, the first-aid kit in the preschool classroom was missing scissors, and the first-aid kits in the school age and young school age classrooms were missing soap.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.
