Violation: Physical punishment was used as evidenced by on July 29, 2025, Alexus Foreman, caregiver, sat Child A on her lap after the child had been hitting other staff and children and told the child if they are going to hit other people then they should know what it feels like to be hit. Alexus then took his hand and held it by the wrist and made a motion with his hand making him hit himself in the face three times. The force used was the force Alexus used as she made him hit his own face. The child was crying when he was made to hit himself in the face.

Violation: A caregiver was not sensitive to the capabilities, interests and problems of children in care as evidenced by a 3-year-old boy in Classroom A was observed crying when the class went outside. Kelsi Prewitt (the designated person in charge) and I went outside so that she could help the teachers with another child. I kneeled and spoke to the child. I asked him if he was tired and having a hard day. The child slightly nodded. The more I talked to him, he slowly quit crying. I got up to finish the walk through of the playground. While walking around the playground, I observed the child crying again. The child still stood in the same spot while Nikki Brigance, caregiver, and Kelsi were standing beside him talking to each other. Nikki went in to get coats for the children that had them. The coats were laid out on a bench to get if they wanted one. The child did not have one. He had on a long sleeve shirt, pants and crocs with no socks and looked to be cold. It was 55 degrees outside, but the wind was blowing, and the child was standing under the shade structure. I asked if he had a coat in the pile, and staff stated he did not. I asked if they had an extra one, so Kelsi went inside to look. The child had snot running down into his mouth and I asked if they had a tissue to wipe his nose. Kelsi was able to get a tissue for the child. I asked if they just let him cry and they stated that he has hard days often and usually does not want to be messed, he will usually sooth himself. This was the child's first day back this week. .
