Noncompliance Area: Two children, ages 8 and 2, were allowed to leave their classroom and leave the facility. The children went to the parking lot to their mother's car that was parked out front.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: Children must be supervised at all times. The legal entity must arrange for all involved staff to receive a minimum of two hours of training regarding supervision of children.

Noncompliance Area: On 11/23/21 Monitoring Inspection visit there were (16) School-age children consisting of young and older school-age with one staff. The group required two staff. Staff #1(director) and Staff #2 (director) were counted in the ratio in multiple classrooms until additional staff arrived. Staff #3 a newly hired floater-staff was assigned to work in the young toddler room, when staff #1 left her alone she was not observing children and did not see when a child was repeatedly swinging a toy and hit a child in the head, or witness the child who was pushed to the floor by a rambunctious child.

Correction Required: A director is responsible for the general management of the facility, including the minimum duties described at §3270.34(a)(1) - (6).

Noncompliance Area: On 11/23/21 inspection the facility had 94 children in attendance. Directors were moving from multiple classrooms to fill-in for the staff coverage that were needed.

Correction Required: The required staff: child ratios must be maintained at all times. When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff: child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: On Thursday, 12/5/19 @ 7:42pm, a parent of an enrolled child at the daycare observed a young toddler child (child#1) repeatedly get up from her seat. She was told to sit down and when she did not, her teacher (staff #1) grabbed her by the arm back into her chair. She reports that the teacher repeated this several times."

Correction Required: A facility person may not use any form of physical punishment.

Noncompliance Area: CHILD #1 WAS OBSERVED SITTING ON THE FLOOR NEXT TO STAFF #1 DRINKING FROM A BOTTLE THAT BELONGED TO CHILD #2 AND CONTAINED BREASTMILK.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times.

Noncompliance Area: DURING 11/2918 RENEWAL INSPECTION, OBSERVED IN INFANT ROOM-A (FRONT) CHILD#1 DID NOT HAVE HIS CRIB LABELED FOR HIS SPECIFIC USE.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: ON 11/26/18 STAFF PERSON #1 WOULD GRAB THE KIDS BY THE ARM TO GET THEM TO THE DESIRED LOCATIONS. SHE WOULD PUT HER HAND ON A CHILD'S NECK TO GET THEM TO PAY ATTENTION AND WOULD VERBALLY YELL AT KIDS CONSTANTLY AND TELL THEM TO SHUT UP.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Noncompliance Area: ON 11/26/18 STAFF PERSON #1 STAFF PERSON WOULD GRAB THE KIDS BY THE ARM TO GET THEM TO THE DESIRED LOCATIONS. WOULD VERBALLY YELL AT KIDS CONSTANTLY AND TELL THEM TO SHUT UP (SOME KIDS CRIED). ONE KID GOT UP TO THROW AWAY HIS FOOD (TRASH) AND SHE GOT UPSET AT THE KID AND STATED HOW SHE WANTS TO HIT THE KID IN THE HEAD WITH THE FOOD PLATE.

Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family.A facility person may not use harsh, demeaning or abusive language in the presence of children.

Noncompliance Area: DURING 11/29 RENEWAL INSPECTION, STAFF PERSON #2 DID NOT WASH THE CHILD'S HANDS AFTER BEING DIAPERED.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Noncompliance Area: DURING RENEWAL INSPECTION ON 11/29/18, WHILE PRESENT IN THE O/T CLASSROOM OBSERVED: (12) OLDER TODDLER CHILDREN WITH ONLY (1) STAFF. A SECOND STAFF PERSON#1 WAS NOT IN THE ROOM, BUT ENTERED THE CLASSROOM WITH SUPPLIES SHORTLY AFTER, RESULTING IN THE GROUP NOT IN RATIO DURING HER ABSENCE.

Correction Required: STAFF CHILD RATIOS MUST BE MAINTAINED AT ALL TIMES. Noncompliance Area: ON 7/30/18 MULTIPLE TODAY'S CHILD CHILDREN ATTENDED CLEMENTON WATER AND AMUSEMENT PARK. A 9YR OLD CHILD WAS UNDERTAKEN BY WATER WHILE PLAYING IN THE WAVE POOL, RESULTING IN THE PARK LIFEGUARD RESCUING HIM FROM THE POOL. ASSIGNED STAFF WERE UNABLE TO SUPERVISE AT ALL TIMES THE WAVE POOL, AND THE OTHER CHILDREN PARTICIPATING IN THE ADDITIONAL WATER AND NON-WATER ACTIVITY AT ALL TIMES. IN ADDITION, THE FACILITY DID NOT HAVE A STAFF CERTIFIED LIFEGUARD ASSIGNED FOR THE MULTIPLE TODAY'S SITE LOCATIONS IN ATTENDANCE.

Noncompliance Area: DURING A TRIP TO CLEMENTON WATER AND AMUSEMENT PARK 0N 7/30/18, THE FACILITY STAFF RATIOS FOR SWIMMING WERE NOT FOLLOWED. IN ADDITION, THE FACILITY DID NOT HAVE A STAFF CERTIFIED LIFEGUARD ASSIGNED FOR THE MULTIPLE TODAY'S CHILD SITE LOCATIONS THAT WERE IN ATTENDANCE.

Correction Required: The staff-child ratios while children are swimming are Infant 1:1; Young or older toddler 1:2; Preschool 1:5; Young school-age 1:6; Older school-age1:8When children are swimming, supervision shall include one person certified in lifeguard training, as described in 3270.31(e)(4)(iii) (relating to age and training).

Noncompliance Area: DURING A TRIP TO CLEMENTON WATER AND AMUSEMENT PARK ON 7/30/18. AN 9 Y.O. ASTHMATIC CHILD WAS RESCUED FROM THE WAVE POOL BY THE PARK LIFEGUARD. DESPITE THE FACILITY WAS AWARE OF THE CHILD'S PRE-EXISTING ASTHMA CONDITION. THE PARENTS AND OR EMERGENCY CONTACTS WERE NOT NOTIFIED TO DISCUSS THE POSSIBLE NEED FOR EMERGENCY CARE FOR HIM. ANY UNSUCCESSFUL PHONE CALL ATTEMPTS THAT MAY HAVE OCURRED WERE NOT DOCUMENTED.

Correction Required: If emergency medical care is needed for a child, the parent shall be contacted as soon as practical in the best interest of the child. If the parent cannot be reached, the operator shall record in writing the reason emergency care was required and the attempts made to inform the parent.

Noncompliance Area: DURING A TRIP TO CLEMENTON WATER AND AMUSEMENT PARK ON 7/30/18. AN 9 Y.O. CHILD WAS RESCUED FROM THE WAVE POOL BY THE PARK LIFEGUARD. THE PARENTS WERE NOT NOTIFIED NOR GIVEN AN INCIDENT REPORT. A REPORT WAS ALSO NOT RETAINED IN THE CHILD'S FILE AT THE TIME ON THE DATE OF THIS INSPECTION VISIT.

Correction Required: A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Noncompliance Area: On the 31st of January a parent brought to the attention of the director an accusation of physical punishment perpetrated by staff person #1. A review of the video from that day did reveal the non compliance.
