Tamy takes time off and closes her daycare early and does not count it toward her 15 vacation days, 5 sick days, 15 holidays, and 5 bereavement days. She closed for 3 days while she was sick and stated that "Those days don't count". When I sat down to have a professional meeting with her to discuss these issues, she was uncooperative, unprofessional and aggressive. She told me that she will run her business how she sees fit and would not acknowledge that charging parents while the daycare is closed is against the law because she is unable to fulfill her portion of the contract (operating hours). She picked up the document I brought to her and threw it in front of me and told me, "I know more about this stuff than you do.". When I attempted to ask why charges us full price when she closes early and showed her evidence of her closing 5hrs, 2.5hrs, 2hrs, 1hr early, she looked at the papers with the evidence and threw them back at me and told me, "those don't matter." and when I responded with, "They matter to me." she proceeded to tell me, "If you are so worried about those little hours, how about I put your child on a 40 hour a week contract and he will be the only kid on that contract since you are questioning me. How would you like that?" and I was dumbfounded that she responded to my questioning fraudulent charges with threats of discrimination. We left that meeting with her digging her heals in, she claimed that she would continue to charge us when she closes. She has a ridiculous amount of paid time off/sick time/holidays in our contract (8 weeks total) but refused to use them for the hours we were complaining about. Then she proceeded to show up unannounced/uninvited to my childs fathers house to drop off papers and relay messages to me on a Saturday. I sent her a cease and desist letter to stop the fraudulent charges and asked that she no longer attempt to discuss this dispute with us as we were going to go through the proper channels, her licensor and the Dept of Human Services, and wanted to avoid conflict while we searched for another provider on Sunday morning. Sunday afternoon she showed up at my house unannounced/uninvited knowing that my child would be with me to confront me and tell me that she is terminating our contract. Then after she terminated our contract, she sent us a text letting us know that she is using her sick/vacation days for the days that we complained about, admitting her guilt. When she originally told us that she wouldn't be counting those days toward her time off and I started asking her questions to get more information and to try to understand, she suggested we come talk to her. So we set up the meeting like she asked, only to be accused of "attacking" her by asking her questions about the situation (she had shared no info with us about the topic, previously and even ignored my asking the questions a month earlier) and then we were met with hostile and aggressive demeanor during the meeting, then she threatened to discriminate against our son for trying to hold her accountable for charging us for services not rendered. Then after the meeting, she proceeded to show up at my sons fathers house to continue the conflict and then showed up at my house to continue the conflict two days after the meeting. This behavior is absolutely unacceptable for someone who takes care of children.
