The Perception Training Center - Pottsville PA Child Care Center

Noncompliance Area: On 8/6/20, Rep observed a mixed age group of older toddlers and preschoolers playing in the outdoor play space that contains mulch. Operator reports that this may have occurred because they have been trying to limit mixing classrooms in play space due to Covid-19.

Correction Required: Pea gravel and other materials with a diameter of less than 1 inch may not be used in spaces where infants or toddlers receive care.

Noncompliance Area: On 7/28/20 during a skype video call, the Rep observed feeding chairs with trays in the Willow room that had openings for straps but did not have straps installed. The operator reports that they do not use the straps because the seats are placed on the floor. Manufacturer's instructions contain a warning to always use restraint system.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Noncompliance Area: On 7/30/20, when Rep reviewed staff files electronically, Facility person #1 began working 9/23/19 and has a signed disclosure statement dated 9/23/19, an NSOR Certification dated 11/8/19, an FBI clearance requested and dated 10/16/19, a volunteer child abuse clearance dated 3/2/19, and a volunteer PSP clearance dated 3/5/19. Facility person #1 was hired provisionally without proof of fingerprinting and with volunteer clearances. Facility person #2 began working 9//23/19 and has a signed disclosure statement dated 9/12/19, a volunteer PSP clearance dated 12/28/18, a child abuse clearance dated 1/2/19an FBI clearance dated 9/14/19 and an NSOR certification dated 11/8/19. Facility persons #1 and #2 are employed as staff.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Persons #1 & #2may not work in a child care position at the facility.

Noncompliance Area: Child #4 has a fee agreement that does not include a amount of the fee to be paid.

Correction Required: An agreement shall specify the amount of the fee to be charged per day or per week.

Noncompliance Area: The operator is currently using fee agreements that do not include the date on which the fee is to be paid.

Noncompliance Area: The written plan for transporting children for medical care was not posted in the Pine & Chestnut rooms. It is also not present in excursion/outdoor bags.

Correction Required: A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.

Noncompliance Area: Children #1, #2, & #3 do not have current influenza vaccines documented on their vaccine records.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: Facility person #1, began working in child care on 3/11/19 and did not receive initial emergency plan training until 4/23/19.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: Facility person #2, had an evaluation on 1/3/17 and not again until 10/24/18, which exceeds the every 12 months requirement.

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Noncompliance Area: Rep observed a window in the Chestnut Room that was open and the opening was greater than 6 inches. The window in the chestnut room opens on to the outdoor play area which is a floor below the Chestnut Room. Operator reports that the window had been previously modified to meet the requirement.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Noncompliance Area: Facility person #1 removed a child's shirt in the classroom, exposing his upper body, causing other children to laugh at him.

Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family.

Noncompliance Area: Staff #1 has used her arm(s) to restrain a child.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Noncompliance Area: Facility person #1 has removed food from children for negative behavior.

Correction Required: Food may not be withheld from a child for purposes of discipline.

Noncompliance Area: Child #1 was injured when he fell inside the facility on 7/26/18. Facility notified parent of injury and when parent came at end of day to pick up child, parent told staff that she might seek treatment for the injury. Child returned to facility on 7/30/18 and parent reported that child received treatment at urgent care for injury. Reported incident via Pelican on 7/30/18. Facility did not telephone notice to the regional office within 24 hours.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

Noncompliance Area: Observed a climbing mat in the Willow Room with 2 small rips in the vinyl covering. Also observed wooden pink tower blocks in the Willow and Pine Rooms with rough edges that cause splinters.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.
