I have used this provider for less than 6 months

If you’re going to have a business, have your contracts I order. Her rates are now as expensive as Brighten or Kids Kare. I thought home daycare would be better. But the amount of days off she gives your child versus what she takes paid is quite expensive … especially if you’re doing it alone. She’s nice enough, but she accused us of being liars when we told her that the contract she presented us with didn’t include all the days off on her website. Just wish things would’ve worked out. She needs to be more organized charging $250 per week.

I have used this provider for more than 6 months

Nicole Cares Daycare is excellent. My son's been there since he was born and 2 years old now and already knows all required for preschool and sightwords. I love love her staff. I wouldn't trust anyone else with my son.

I have toured this provider's facility, but have not used its services

Be careful with what you sign …

Before moving to Clovis, I found Nicole Cares website and contacted her for availability and questions. She seemed very nice. She told us she had a waitlist and would contact us as she anticipated an April opening.

After we arrived to California, I received notification end of February that she had a spot mid March; the next opening in May. I told her we were anticipating an April start as I wasn’t quite ready to start in two weeks. However, we wanted to tour and meet her before locking in the May date. We toured the home in March. We liked her set up and Nicole’s personality.

After we left the tour, she text saying his start date would be June 13th. She sent over her contract and documents to which we reviewed, completed and signed. She invoiced us and we paid March 23rd for a June 13th start.

End of April she text with an early May opening. I just started a new job and my son was receiving speech therapy so I opted to wait until June as planned.

End of May, I was excited about my son starting and was about to show her website to a friend and noticed some changes. She added a month of maternity/emergency leave and additional holidays. I emailed her and she said it was in my contract. I checked my contact and it wasn’t there. However, rather argue, I figured I would address when we started daycare for fear of arguing.

A couple weeks back, I had a tragedy in the family and asked to push him back one week until June 20th. She agreed and expressed her condolences. June 12th she advised her son tested positive for COVID and she would be closing the daycare that week. Two days later I asked to push back one more week to June 27th seeing as I had COVID twice and my son once, so I wanted to make sure everything was clear. She agreed and let me know her husband also tested positive. I sent her prayers as my family too had been impacted so I understood what she was going through.

I received an invoice June 17th for two weeks of service. I questioned the invoice which opened the door to another conversation about her website changes. We, unfortunately, ended up in an ugly exchange of text messages because she claimed that her website is the guiding document. I explained that her contract is a legal document to which we enrolled based on. She accused me of downloading incorrect forms when she emailed them to me!

Later she called very apologetic as the tone of text messages are often misconstrued. I explained to her that we are not comfortable with the changes and didn’t agree to them. She added 1 month maternity/emergency leave plus two holidays to her website. She accused us of denying her maternity leave. I explained to her that her contract should be fair. The contract we signed did not have a month leave and two additional holidays and allows the kids to receive vacation and sick AFTER six (6) months of attendance.

So why should we pay you if our kids don’t have the same rights? Double standard.

We parted ways and she agreed to half our tuition (deposit).

I messaged her a couple days later asking that she electronically transfer seeing as she told my husband and I she would be open this week and we could stop by for a check. I wasn’t comfortable with that if members of her family were still testing positive and doing “really bad” - her words not mine.

Yesterday, I noticed she changed her website again! After consulting some professionals, I was advised that she should refund my full tuition as I had done nothing wrong. She had blamed us for signing the wrong contract which, by her admission, would be null in void. She said we would have to sign an addendum as she had new play equipment not listed on the contract SHE sent us and we signed in March.

Also, after scrolling through our text messages, she claims to have held a spot for my son for a long time when she kept adjusting the start dates; not us! I only request a change this month when I had a family tragedy and obviously when her home tested positive for COVID.

I contacted Nicole directly last night requesting the residual of our funds. I did tell her I would post warning other parents because what she’s doing is greedy and unfair. Thirteen (13) holidays/birthday, plus sick, vacation and one month maternity/emergency leave is a little excessive and not fair to both the children and parents.

She asked me to not contact her anymore.

In closing, make sure you read your contract thoroughly and that she sends it to you.

Her website is not a contract!

She really seems like a nice woman … but the time off parents have to pay for is more than some parents get from their employers! It should go both ways - which I expressed to a couple days ago. Our conversation obviously prompted her to change her website from requiring kids to attend six (6) months to one (1) month to qualify for time off.
