Staff #1 placed the child's hands together behind his back and then straddled the child's lower body for approximately 20 seconds fully restricting the child's ability to move. Staff #1 released Child #1 when the child's mother walked into the classroom. It was also observed in the video that Staff #2, Staff #3 and Staff #4 observed the actions of Staff #1 and did not intervene or seek assistance from facility leadership. Further, during an interview Staff #4 stated that she had observed other staff persons use similar methods with other children in care and believed the methods were acceptable as a 'last resort.'

The YWCA Adams Commerce Director will be mentoring the YWCA Director and Asst. Director in their new leadership roles at the 909 Fairfield location. A coaching model will be implemented to train the all staff to complete lesson planning, child observation and inclusive practices. The staff will learn methods to include the five steps of positive re-direction (as explained under the plan of correction for the training violation), completing a (BIR) Behavioral Incident Reports to track individual challenging behaviors. BIR's will help staff to analyze the behavior, time of the behavior, what happen before the behavior started, how the staff responded to the behavior, etc. The BIR will then be shared with the family to include their impute and create individual behavioral plans for the center. The (SACERS) School Age Environmental Rating Scale will be completed in January 2020 and repeated in April 2020 to monitor the progress of the staff. The coach will complete staff observations and review lesson plans to make sure the scheduling and activities will provide students with opportunities to make choices while showing respect for each student as an individual, respecting their personal privacy, lifestyle and cultural background while maintaining proper supervision. The YWCA CEP directors with the Executive Director take these infractions very seriously. Staff #1 was terminated from his position at the YWCA Gettysburg and Adams County. The remaining staff have been re-trained on the current policy in the CEP Staff Handbook on page #7 and #8 which covers Discipline and Behavior Management; as well as the DHS regulation 3270.113 (b). Going forward these steps will ensure that ALL staff will have a thorough understanding of the regulation 3270.113(b). Facility staff will not use any form of physical punishment, including spanking a child. Further steps are being taken to be sure the staff at the YWCA have the proper training and support for handling all situations including challenging behaviors that may arise while children are in our care. #1 The YWCA will now have a Child Enrichment Program Administrative Director who will mentor and coach Karin Padilla, CEP Director and Ashley Boone, CEP Assistant Director in their new leadership roles at the YWCA Fairfield location. #2 The CEP directors / administration will complete staff observations on a daily basis providing documentation to DHS/OCDEL on a weekly basis to include date and time of the observation and staff will sign off that they have been observed. The observations will be reviewed with classroom staff and a signed copy will be maintained in a file for each classroom and kept in the Director's office for review as needed by DHS/OCDEL. #3 The Assistant Director of each facility will take on a coaching role for the staff assisting them through classroom observations followed by a meeting to reflect on the information collected during the observation. The AD / Coach will then recommend training for any items the staff feel they need to support their professional development. Going forward these steps will ensure that ALL staff will have a thorough understanding of the regulation 3270.113(b). Facility staff will not use any form of physical punishment, including spanking a child. The Assistant Director will serve as the coach for all current staff as well as future staff hire at the YWCA. I have addressed this noncompliance issue by addressing staff #4, and all other staff, that we will no longer use the farthest bathroom to the classroom in the hallway if we do not have an extra staff to supervise that area. If we do have an extra staff to supervise the farthest bathroom to the classroom we will allow the children to use that bathroom. The extra staff will supervise and direct the children as needed.

This issue was addressed on the day of inspection and resolved that same day. YSteps will no longer be using the hallway sinks. All Ysteps staff will be bringing in one stroller at a time, that has 4 children and will wash hands in the classroom. This way we will meet ratios and stay in compliance. We will submit a document for DHS to approve so they can check on the weekly basis for 3 months.
