Description: Supervised at all times

Noncompliance Area: During allocated unannounced inspection on August 6, 2025, the mat placement in the Pre-K classroom did not allow for staff #4 to adequately see all children at all times. Staff #4 was the only staff person in the room.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: During allocated unannounced inspection on August 6, 2025, Staff person #1 was observed to be caring for children unsupervised. Staff person #1 does not have current pediatric first-aid/CPR training. This is evidenced by the previously documented pediatric first- aid/CPR training expiration date of 6-2025.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service trainings are completed, staff person #1 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Noncompliance Area: During allocated unannounced inspection on August 6, 2025, Facility persons #2 and #3 were observed being used in ratio for 12 school age children during swimming. Upon file review, it was determined that facility person #2 is under 18 years of age, therefore can not be used as a staff person in swimming ratio.

Correction Required: A staff person shall be 18 years of age or older. The staff-child ratios while children are swimming are Infant 1:1; Young or older toddler 1:2; Preschool 1:5; Young school-age 1:6; Older school-age1:8.

Noncompliance Area: During renewal inspection on March 21, 2024, operator did not have a letter to provide to the parents of each enrolled child explaining the emergency procedures, and the document posted in the facility did not include lockdown provisions.

Correction Required: The facility shall have an emergency plan that provides for accommodations for shelter of children during an emergency including lock-down, shelter in place at the facility and shelter at locations away from the facility premises. The operator shall provide to the parent of each enrolled child a letter explaining the emergency procedures. Description: Infant sleep position

Noncompliance Area: At the time of inspection, there were two infants sleeping in sacks that restricted their movements. The sacks swaddled each child and restricted their arms and legs.

Correction Required: Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.

Description: Building Surfaces

Noncompliance Area: Throughout the outdoor play area there was broken sinks, wood, and a shed that needed to be repaired.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Refrigerator/Potentially hazardous food refrigerated

Noncompliance Area: At the time of inspection, facility children's lunch was observed in two refrigerators, in the preschool classroom. One refrigerator did not have a thermometer. The second refrigerator's thermometer exceeded fifty degrees and was in the danger zone.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator. Potentially hazardous food brought from the child's home or provided by the facility shall be refrigerated.

Description: Director responsibilities/Director only 45 children enrolled

Noncompliance Area: During the inspection on 3/1/23, the director who was observed working in the classroom with children stated the current enrollment exceeded more than 50 children.

Correction Required: A director is responsible for the general management of the facility, including the minimum duties described at §3270.34(a)(1) - (6). A director may not function as a group supervisor in a facility in which more than 45 children are enrolled.

Regulation: 3270.81

Description: Glass

Noncompliance Area: In the common space at the facility entrance and in two pre-school classes. There were doors with elongated glass that did not have any visual identification which could pose a hazard if a child walked into it.

Correction Required: A visual strip or other visual identification shall be placed on glass located in a traffic area, a child care space or a play space.

Noncompliance Area: AT TIME OF RENEWAL INSPECTION, THE OUTSIDE PLAY AREA HAD A BENCH WITH EXPOSED NAILS AND SPLINTERING WOOD. FOUR SECTIONS OF FENCING HAD SHARP/RUSTY EDGES ESPOSED AT THE BOTTOM.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: AT TIME OF INSPECTION THERE WERE SEVERAL TOYS IN THE TWO AND THREE YEAR OLD CLASSROOM THAT HAD A DIAMETER OF LESS THAN ONE INCH AND COULD POSE A CHOKING HAZZARD.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: AT TIME OF RENEWAL INSPECTION, HIGH SCHOOL STUDENTS WHO VISIT CLASSROOMS AND INTERACT WITH CHILDREN AT THE FACILITY OVER A 4 WEEK PERIOD, DID NOT HAVE FILES WITH REQUIRED DOCUMENTATION ON SITE AT THE FACILITY.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person # -- may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. An individual record is required for each facility person.

Noncompliance Area: AT TIME OF RENEWAL INSPECTION, THERE WAS AN OUTLET STRIP THAT DID NOT HAVE PROTECTIVE COVERS IN THE UNUSED OUTLETS.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: AT TIME OF RENEWAL INSPECTION, A BOTTLE OF WINDEX WAS ACCESSIBLE TO CHILDREN IN THE TWO AND THREE YEAR OLD ROOM. A PHILODENDRON PLANT WAS IN THE PRE-K 2 CLASSROOM.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Toxic plants are not permitted in a child care space.

Noncompliance Area: AT TIME OF RENEWAL INSPECTION, THE VENTS IN THE KINDERGARTEN ROOM AND A FEW IN THE HALLWAY OUTSIDE OF THE ROOM ARE DIRTY AND IN NEED OF BEING CLEANED.
