Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. Each review and update of the emergency plan shall be documented in writing and kept on file at the facility.

Noncompliance Area: The child file for Child #1 and Child #2 contained a current emergency contact information form that lacked the addresses for three of the designated release persons listed.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: The child file for Child #2, contained an initial health report that is dated 3/9/23 which is more than 60 days after initial enrollment. The child file for Child #3, contained an initial health report that is dated 12/21/22 which is more than 60 days after initial enrollment.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Emergency plan

Noncompliance Area: An annual emergency drill conducted on 6/30/23 lacked the time it took to complete drill, special accommodations the facility used for any category of children, and any problems encountered that is required to be documented when conducting the emergency drill, per announcement C-22-04.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Description: Locked or inaccessible - in original container

Noncompliance Area: In the Main Room, a container of disinfex multipurpose wipes labeled 'Keep Out of Reach of Children' was observed on a ledge accessible to the preschool age children in care. Purell hand sanitizer labeled 'Keep Out of Reach of Children' was observed on a desk accessible to the children in care.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Description: Supervised at all times

Noncompliance Area: At approximately 11:30am during nap time in the Main Room, five children were observed to be sleeping inside sleeping bags that were covering their face and head thus causing staff to not be able to see their faces in order to properly supervise and assess the needs of those children.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Infant: updated health report every 6 months/Initial and subsequent health assessments

Noncompliance Area: The child file for Child #1, who was a young toddler at the time, was observed to contain an updated health report dated 7/7/22 which was conducted more than 6 months from the previously dated 10/12/21 health report on file.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler. A child's record must contain initial and subsequent health reports.

Noncompliance Area: The facility emergency plan lacked information regarding volunteer emergency preparedness as well as a plan for continuity of operations in their emergency plan.

State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: Staff person #1 and Staff person #2 were observed to be caring for children unsupervised. Staff person #1 and Staff person #2 had not completed the following pre-service training required prior to caring for children unsupervised: Health and Safety Training; the health and safety training on file was completed prior to 9/30/16 and is not considered an acceptable training.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. Noncompliance Area: Staff person #1, Staff person #2, and Staff person #3 have not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): Health and Safety Training; the health and safety training on file was completed prior to 9/30/16 and is not considered an acceptable training.

Correction Required: Staff person(s) shall complete professional development in the topics of 3280.31(f)(1 -- 10) within 90 days of hire. Staff person #1, Staff person #2, and Staff person #3- will have until 2/12/23 to complete the required training. Until such time as the required training has been completed, Staff person #1, Staff person #2, and Staff person #3--- must be supervised, when interacting with children, by a primary staff person who has completed the required training related to this citation. If there are no staff available to supervise Staff person #1, Staff person #2, and Staff person #3 may not work in a child-care position at the facility.

Description: FIRE DETECTION/Staff responsibility

Noncompliance Area: Upon review of the facility's 30-day fire alarm testing log the following tests were observed to have been conducted more than 30 days apart: 6/8/22 - 7/11/22 (33 days), 7/11/22 - 8/12/22 (32 days), 9/8/22 - 10/10/22 (32 days), 11/9/22 - 12/12/22 (33 days), 12/22/22 -1/26/22 (45 days).

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Correction Required: An agreement shall be signed by the operator and the parent. An agreement shall specify the amount of the fee to be charged per day or per week.

Noncompliance Area: Child file #3, contained a health report dated 12/10/18 and lacked an updated health report annually as required for a preschool child in care.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: Child files #1, #2, #3 and #4 lacked documentation of influenza vaccinations annually in accordance with the schedule recommended by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: The bottles for the infant in care during inspection lacked a label that indicated the child's name.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Noncompliance Area: The facility lacked operable interconnected smoke detectors on all floors of the residence. The facility had operable stand alone battery operated smoke detectors in the basement and on the first floor, but not on the second floor. The facility obtained and installed a stand alone battery operated smoke detector on the second floor during the inspection.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The facility lacked sterile gauze pads in the first aid kit.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: Staff placed soiled diaper in a plastic bag after removing from the child, tied plastic bag up and proceeded to take it into the kitchen to put in the garbage can.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Noncompliance Area: Child file #1, DOE 7/11/18, contained a health assessment dated 12/13/18 which was not within 60 days of admission into the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Noncompliance Area: Staff file #1, DOH 7/30/18, contained a CJIS Clearance dated 9/28/18, which is not the correct DHS FBI clearance as required.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Noncompliance Area: The file for Child #1, a preschool child, lacked a health report that had been updated at least every 12 months

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: Child file #1 lacked the physician information on the emergency contact form.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Noncompliance Area: The facility lacked a written emergency transport plan identifying the means of transporting a child to emergency care.

Correction Required: A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.
