A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The files for children #4 and #5 lack updated toddler health assessments.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.A child's record shall contain initial and subsequent health reports.

Noncompliance Area: Staff #1 lacks an updated health assessment.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: Staff #2 did not complete annual emergency plan training.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: The file for staff #2 lacks annual fire safety training.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: Observed a television on a stand that became unstable when the drawers for the tv stand were opened.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Noncompliance Area: On 12/19/18, only one staff person was present with 1 infant and 2 toddlers for a brief period of time when the second staff went to pick up baby bottles for an enrolled infant.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Noncompliance Area: Observed torn rest mats. Observed one leaking bathroom sink. Observed one torn changing/diapering pad.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: Observed pack n plays in use without children's names on them.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: The files for children #1, #2, and #3 lacked agreements.

Correction Required: An agreement shall be signed by the operator and the parent.A child's record shall contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Noncompliance Area: The file for child #4 lacks signed parental permission for emergency medical care and minor first aid.

Correction Required: A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: The files for staff #2 and #3 lack annual IN PERSON fire safety training. The staff completed an online fire safety training.

Facility Person #1may not work in a child care position at the facility until a valid criminal clearance is on file at the facility. A facility person's record shall include a copy of the criminal history record, the FBI clearance, child abuse registry clearance information, and a copy of the disclosure statement as required under the CPSL.

Noncompliance Area: Room 406 lacked a first aid kit.

Correction Required: A first-aid kit shall be in a child care space.

Noncompliance Area: Observed a damaged piece of trim on the floor in the bathroom and an exposed bolt on the toilet in the bathroom in room 406.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: Observed one area of damaged plaster in the bathroom in room 406.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: Upon arrival at the facility at 12:29pm, staff #1 requested that the certification representative wait until she was permitted access to the facility. At 12:33pm, since the certification representative still had not obtained access to the facility, the certification representative started to leave the facility. Staff #1 approached the certification representative outside of the facility to ask that the certification representative return later. Staff #1 indicated that the facility director and another staff person were not at the facility. When the certification representative learned that children were in care at the facility at that time, the certification representative indicated that she MUST be permitted access to the facility and children.

Correction Required: A staff person shall provide to agents of the Department immediate access to the facility, the children and the files and records

Noncompliance Area: The file for staff #1, classified as an aide, lacks verification of completion of a high school diploma or a general educational development certificate. (RECITED)

Correction Required: An aide shall have attained one of the qualification levels specified in 3270.37(b)(1)-(3).A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Observed staff #1, who is qualified as an aide providing care to 3 infants, 3 young toddlers, 1 older toddler, and 1 preschooler in the middle room at approximately 12:35pm without the supervision of a staff person qualified at minimum as an assistant group supervisor. (RECITED)

Correction Required: An aide or a combination of aides shall be supervised at all times by a staff person qualified at minimum as an assistant group supervisor.

Noncompliance Area: Observed staff #1 providing care to 3 infants, 3 young toddlers, 1 older toddler, and 1 preschooler in the middle room at approximately 12:35pm. No other staff person was a caregiver in the room.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level). The required staff:child ratios must be maintained at all times.

Noncompliance Area: Observed staff #1 providing care to 3 infants, 3 young toddlers, 1 older toddler, and 1 preschooler in the middle room at approximately 12:35pm. No other staff person or facility person was present at the facility.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Noncompliance Area: Observed staff #1 providing care to 8 children including 3 infants, 3 young toddlers, 1 older toddler, and 1 preschooler in the middle room at approximately 12:35pm. The capacity of the middle room is 7 children.

Correction Required: Indoor child care space is measured within permanent stationary partitions or walls. The allowable number of children in a space is determined by dividing the total square feet in a space by 40.

Noncompliance Area: Observed sharp metal fixtures in the playground that were accessible tot he children.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.

Noncompliance Area: Observed a holly bush in the playground.

Correction Required: Toxic plants are not permitted in a child care space.

Noncompliance Area: Observed damaged plaster in the bathroom on the wall near the floor in room 406.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: Observed 2 infants resting in pack-n-plays in the infants/toddlers room without 2 feet of space on three sides of the pack-n-play rest equipment while the equipment was in use at 10:30am.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Noncompliance Area: Observed 2 infants being cared for in the infant/toddler room at 10:30am by one staff. While the infants were being cared for, the room was very dark and there was loud music playing. The lack of light and loud music did not allow the caregiver to be able to see, hear, and assess the infants adequately.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be adequately supervised by a staff person at all times.

Noncompliance Area: Observed an infant sleeping in a pack-n-play on her stomach. This is not the sleeping position recommended by the American Academy of Pediatrics for infants.

Correction Required: Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.

Noncompliance Area: Observed a bag on the shelf in the older kids room (front room) that had adult medications in it. The bag was accessible to children that were in care in that room.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: The file for staff #1 lacks a health assessment that was conducted within 12 months prior to providing initial service in a child care setting.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility/staff person # 1 may not work in a child care position at the facility until a valid FBI clearance is on file. A facility person's record shall include a copies of the criminal history record, the FBI clearance, child abuse registry clearance information, and a copy of the disclosure statement as required under the CPSL.

Noncompliance Area: Observed 1 preschool aged child and 2 young school aged children sleeping in the large muscle play room at 10:30am without a staff present in the room.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: Observed one damaged toy truck in the front room (older kids).

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.A child's record shall contain initial and subsequent health reports.

Noncompliance Area: The sink in the back room (infant/toddler) lacked paper towels to be used for handwashing.

Correction Required: Paper towels may be used as towels and washcloths. Paper towels shall be discarded after each use.

Noncompliance Area: The file for staff #1 lacks 6 hours of annual child care training. The file for staff #2 lacks 3 hours of annual child care training.

Correction Required: A staff person shall obtain an annual minimum of 6 clock hours of child care training.A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: The file for staff #1 lacks verification of a college degree.

Correction Required: A director shall have attained a bachelor's degree from an accredited college or university in early childhood education, child development, special education, elementary education or the human services field and 1 year of experience with children.A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Staff #2, who is qualified as an aide, was caring for a child (OT) without the supervision of a staff person who is minimally qualified as an assistant group supervisor in the back room (infant/toddler room).

Correction Required: An aide or a combination of aides shall be supervised at all times by a staff person qualified at minimum as an assistant group supervisor.

Noncompliance Area: The water at the sink in the back room (infant/toddler) exceeded 110 degrees F. The water is used for handwashing for children including the required handwashing at the diapering area.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: In the back room, one small piece of plastic was observed in an unlocked Sterlite-style drawer container. In addition, plastic gloves were stored in an unlocked drawer directly below the diapering table. In the front room, where a toddler was receiving care, one small craft pom-pom was observed an unlocked Sterlite-style drawer with the other craft supplies.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: In the front room, a Disney fabric couch was observed to have exposed staples under the cushion. Also, food residue was observed underneath the cushion.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child`s size, age and special needs.

Noncompliance Area: The file for Child #2, who was stated to have been in attendance for two weeks, lacked an Agreement and an Emergency Contact Form as well as any emergency contact information. Staff were also unsure of his age.

Correction Required: An agreement shall be signed by the operator and the parent. Emergency contact information is required for each enrolled child. Emergency contact information must reference who shall be contacted in an emergency.

Noncompliance Area: The Emergency Contact Forms for Child #1, 3 & 4 lacked the addresses for individuals designated by the parent to whom the child may be released.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: Emergency Contact Forms were not present in the Middle or Back Rooms.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: Emergency Transportation Plans were not posted in the Middle or Back Rooms or in the first-aid kits which are intended to be taken on excursions.

Correction Required: A written plan identifying the means of transporting a child to emergency care and staffing provisions in the event of an emergency shall be displayed conspicuously in every child care space and shall accompany a staff person who leaves on an excursion with children.

Noncompliance Area: Neosporin and Motrin were observed in one of the first-aid kits in the facility restroom.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container. A parent shall provide written consent for administration of medication or a special diet.

Noncompliance Area: The file for Staff #1 lacked a health assessment and TB test.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. Noncompliance Area: The files for both Staff #2 & #3 both contained verification of experience that was deemed unacceptable, as the operator completed and signed the Work Experience forms and were not signed by the experiential entities. In addition, the educational transcripts in the file for Staff #2 do not indicate highest lvel of education attained. Written references contained no indication of hours worked so could not be substituted.

Correction Required: A facility person`s record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Noncompliance Area: In the play area, the unused projector system was observed to be sitting atop of a bar stool at child's height, posing a toppling hazard. A roll of Scotch tape with the cutting blade intact was observed in the front room in an unlocked Sterlite-style drawer unit, posing a cutting hazard. An Older Toddler was receiving care in the room.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The Certificate of Compliance was posted inconspicuously in a back corner.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: The files for Staff #3 & 4, listed as Staff, contained Volunteer disclosure statements. The file for Staff #3, hired on 2/18/17 as a provisional hire, contained an PA State Police clearance still under review and was observed to be supervising the children unsupervised by a permanent staff member. The file for Staff #4, a provisional employee, lacked a completed FBI clearance but was also observed to be supervising children without supervision of a permanent staff member.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.

Noncompliance Area: The file for Staff #2, who was listed as and performing the duties of an Assistant Group Supervisor, contains verification showing that Staff #2 has not yet attained a high school diploma. Staff #2 was observed to supervise children without the supervision of an Assistant Group Supervisor or higher.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children. An aide or a combination of aides shall be supervised at all times by a staff person qualified at minimum as an assistant group supervisor.

Noncompliance Area: In the back bathroom, an unlabeled bottle of white liquid was observed in an unlocked under-sink cabinet.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The back room lacked a first-aid kit.

Correction Required: A first-aid kit shall be in a child care space.

Noncompliance Area: The posted diagrams of the building's interior lack indication of the routes out of each child care space.

Correction Required: Evacuation routes shall be posted.
