A safe indoor and outdoor environment was not provided for the children. A staff member abruptly opened a door between two classrooms and did not ensure the doorway was clear. The staff member hit a two-year-old child with the door, causing the child to fall.

A staff member accidentally hit a two-year-old child with a door when the staff member was entering the classroom, causing the child to fall. The staff member yelled at the child for standing near the door and grabbed the child by the arm to stand back up, resulting in a bruise on the child's arm.

The discipline policy was not followed. The discipline policy the center used indicated staff use effective guidance and behavior management techniques that focus on a child’s development and that staff use short, supervised periods of time-out sparingly. Based on observations and interviews, time out for five minutes was used with a two-year-old child. Staff walked the child to the table, was told to sit and place their head down on the table and to not cry.

Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. In space #3, the teacher assigned to the group of children made the following statements to a 2-year-old child “Sit at the table and put your head down and I don’t want to hear you crying”, “As long as you are crying you won’t get up” and “If you hit another child, you will sit there the whole time until we eat”. When asked how long she waits for the child to stop crying, the teacher said about five minutes. Other statements made by the lead teacher and teacher included “don’t do that” “you don’t have to scream” talking to a 2-year-old who was non-verbal. Also, the lead teacher, while changing a diaper, raised her voice at a child asking, “who threw that?” referring to a book and asked, “why’d you throw that book?” The lead teacher said “stop, you’re too loud to the non-verbal 2-year-old child saying “I don’t want to see that. Stop throwing those (a type of toy)”
