Noncompliance Area: At the time of inspection on 1/23/20, the scheduled posted at the facility listed activities beginning at 8am. Per the staff the facility opens between 6-6:30 am. Yet, the schedule does not list any activities prior to 8am. At 7am the facility children were not engaged in activity that promote skill development, the children were observed on cots; some sleeping until the second facility staff person arrived at 8:09am.

Correction Required: A written plan of daily activities and routines, including a time for free play shall be established for each group. The plan shall be flexible to accommodate the needs of individual children and the dynamics of the group. Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.

Noncompliance Area: During the inspection on 1/23/20, Staff #1 (facility director) was observed caring for 12-mixed age children between the hours of 7-8:09 am, The second staff person (staff #2) arrived at 8:09 am.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level). At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Noncompliance Area: In the toddler classroom at the time of inspection, broken toys and small games pieces were observed in the classroom. The broken toys could pose harm to the children and the small pieces could pose a choking hazard if place in the child's mouth.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts. Pea gravel and other materials with a diameter of less than 1 inch may not be used in spaces where infants or toddlers receive care.

Noncompliance Area: Food which was served to the children was observed in the facility refrigerator that was not a safe food temperature during the inspection on 12/30/19.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45 F or below. An operating thermometer shall be placed in the refrigerator.

Noncompliance Area: Facility children were observed moving from room-to-room without direct staff supervision.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: Children must be supervised at all times.

Noncompliance Area: The emergency contact information for facility children #1-#5 did not have current emergency contact information in their child care space. during the facility renewal inspection.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: At the time of inspection, there was no written proof of a recent physical in the file for facility child #5.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child. A child's record shall contain initial and subsequent health reports.

Noncompliance Area: Unlabeled bottles with milk were observed on the counter at the time of inspection on 12/30/19. The potentially hazardous was not refrigerated as required by DHS-OCDEL regulations.

Correction Required: Potentially hazardous food brought from the child's home or provided by the facility shall be refrigerated. Disposable nursers and bottles shall be labeled with the child's name.

Noncompliance Area: There was no written record at the time of inspection for facility child #3.

Correction Required: An operator shall establish and maintain an individual record for each child enrolled in the facility.

Noncompliance Area: There was no signed permission for child (ren) #1-#3, #4, and #5 during the facility inspection.

Correction Required: A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: At the time of inspection, there was no mechanism in place to allow staff to turn lights off and on in the facility classrooms. Each time the staff turned lights off and on they had to use the main breaker box/electrical panel.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: At the time of inspection, the facility certificate of compliance was posted for the parents in an conspicuous location

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: At the time of inspection, the facility did not have written proof of an emergency plan which was posted and updated annually

Correction Required: The facility shall have an emergency plan that provides for evacuation of children from the facility building and evacuation of children to a location away from the facility premises. The evacuation routes and evacuation plans to exit the building may be the same as those required by 3270.94 (f) and (g) (relating to fire drills).

Noncompliance Area: At the time of inspection, there was no written proof of annual staff training on the facility emergency plan.

Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. The operator shall document in writing each review and update of the emergency plan and kept on file at the facility.

Noncompliance Area: At the time of inspection on 1/23/20, twelve (12) toddler and preschool children were observed in front room of the with one staff person. This is continued non-compliance.
